These Terms govern your use of MetalCutHQ. We've written them to match how the Platform actually works — not in boilerplate. Numbered sections, copy-able anchors, plain language.
By creating an account or otherwise using MetalCutHQ (the “Platform”), you agree to these Terms. If you're using the Platform on behalf of a company or organization, you represent that you have the authority to bind that organization.
If you don't agree to these Terms, don't use the Platform.
- Platform — the MetalCutHQ website, app, and related services operated by MetalCutHQ.
- User — any person with a Platform account (including both customers who submit quotes and Shop administrators).
- Shop — a metal fabrication business using the Platform to receive orders and fulfill them.
- Order — a quote or purchase request submitted through the Platform by a User to a Shop.
- User Content — files, drawings, geometry, and other material a User uploads or submits through the Platform.
MetalCutHQ is a software service. We provide the tools that let Users upload CAD files, see pricing based on a Shop's configured economics, and submit Orders to that Shop.
We are not a metal fabrication shop. When you submit an Order through the Platform, the Shop is the party responsible for fabricating, fulfilling, invoicing, and warranting the work. Contracts for manufacturing and delivery are between you and the Shop — not between you and MetalCutHQ.
Pricing shown on the Platform reflects the Shop's configured rules at the moment of quoting. A Shop may decline, revise, or re-quote any Order before it is accepted and fulfilled.
You must be at least 18 years old to create an account. You're responsible for keeping your login credentials secure and for all activity under your account.
If you suspect unauthorized access, notify us at info@metalcuthq.com immediately. We may suspend accounts that show signs of unauthorized use, abuse, or breach of these Terms.
You retain ownership of all User Content you upload — including CAD files, drawings, and geometry data. We don't claim any ownership of your designs.
To operate the Platform, you grant MetalCutHQ a limited, worldwide, non-exclusive, royalty-free license to store, process, and display your User Content onlyto the extent needed to: (i) parse geometry for pricing, (ii) show the files back to you, and (iii) share them with the Shop you're quoting or ordering from.
You grant the associated Shop a limited license to access your User Content for the sole purpose of quoting and fulfilling your Order. We do not share User Content with third parties beyond the Shop you're working with, and we do not use it to train AI models.
If you're a Shop administrator, you are solely responsible for:
- The accuracy of your catalog, materials, services, finishes, and pricing rules.
- Fulfilling Orders you accept — including manufacturing, quality, delivery, and any required regulatory compliance.
- Invoicing, taxation, and any payment arrangements with the User.
- Honoring any warranty, return, or dispute resolution process you offer.
MetalCutHQ is not a party to the manufacturing contract between a Shop and a User, and is not responsible for defects, delays, or damages arising from Shop fulfillment.
When a quote is generated, the Platform captures a price snapshot: the complete pricing breakdown at that moment, including the Shop's rules as configured. When you submit an Order, a fresh snapshot is frozen against that Order — later changes to Shop pricing don't retroactively change a submitted Order's total.
Orders pass through defined states: requested → quoted (where a Shop may revise the total before the User accepts) → accepted, then through production and delivery. A Shop may reject an Order at any point before acceptance.
Fees
Use of the Platform may be subject to fees disclosed to you at sign-up or prior to your first Order. As of the date above, direct payment for fabricated parts is handled between the User and the Shop outside the Platform.
We'll give you reasonable notice of any fee change and provide a chance to cancel before a new fee applies to your account.
You agree not to:
- Use the Platform to request or fulfill parts that are illegal to manufacture in the applicable jurisdiction (including regulated firearms components, controlled goods, or sanctioned items).
- Upload User Content you don't have the right to share, or that infringes third-party intellectual property.
- Attempt to probe, scan, or test the vulnerability of the Platform without our written authorization.
- Use the Platform to harass, defraud, or mislead another User.
- Scrape, resell, or redistribute Platform data, pricing, or other Users' content without authorization.
The Platform is provided “as is” and “as available” without warranty of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law.
Without limiting the foregoing, MetalCutHQdoes not warrant that pricing shown on the Platform is error-free, that any particular Shop is available to fulfill a given Order, or that geometry detected by the Platform's automated parsing is free of inaccuracies. You are responsible for reviewing pricing and geometry before committing to an Order.
To the maximum extent permitted by applicable law, MetalCutHQ and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenues, goodwill, or data, arising out of your use of the Platform.
MetalCutHQ's aggregate liability for any claim arising out of or relating to the Platform will not exceed the greater of (a) fees you've paid to MetalCutHQ in the twelve months preceding the claim or (b) CAD $100.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.
You agree to indemnify and hold harmless MetalCutHQ and its directors, officers, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of:
- Your breach of these Terms;
- Your User Content or your use of the Platform, including any manufactured part derived from your User Content;
- Your violation of any law or third-party right, including intellectual property or privacy rights.
You may close your account at any time. We may suspend or terminate your access to the Platform if you breach these Terms or create risk or legal exposure for MetalCutHQ or other Users.
Sections that by their nature should survive termination — including User Content licenses for completed Orders, limitations of liability, indemnification, and governing law — will survive.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You and MetalCutHQ submit to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of or relating to these Terms or the Platform.
We may update these Terms from time to time. When we do, we'll update the “Last updated” date above and, for material changes, notify active Users. Continuing to use the Platform after changes take effect means you accept the revised Terms.
